The Return of Jim Crow
by floridagirl25

How are the lower courts to make practical use of today's decision? As Roberts and Alito cling to the facade of stare decisis that they affirmed in their confirmation hearings, yet overturn past decisions, in practice, what will the lower courts use for guidance? This virtually guarantees new lawsuits, while segregation drags on and damages the fabric of the cities in which it takes place.

And it is so exciting to see a group of old white men making these decisions - and that includes Clarence Thomas.

Practical use? This decision was 100% spot on in declaring that Brown was not a decision that made artificial integration a self-perpetuating right. Brown addressed the inequities and real segregation barriers at a particular point 50 years. No such barier exists as such currently, and the "practical use" of Brown had been perverted to effectively racially discriminate against white students for admissions to public schools in the city. (A city I lived in for most of the last decade BTW)

The protections Brown established work for all students/races and that was redressed with this common-sense and legally sound decision. Justice Roberts had his finger on the pulse with his comments on the sorid business of divying us up by race.
