That already appears to be the situation now. Courts especially civil courts are supposed to be based on equal ground but that does not apply here.
Right now women who realy need the protection are not getting the protection because they are at risk of retribution. The women who are going to court aren't going because the are real victims, they are going to get the last word in their argument and they have nothing to risk.
If you file a false arrest in other situations, you could be opening yourself to arrest and a lawsuit and your argument should apply there just as much. The really screwed up thing about it is that you have ego maniacl officials who like to look like heros defending the poor innocent victim wannabe and they are preying on the victims more than a lot of the suspects.
That judge in Broward that suddenly showed up at the mentaly disturbed "victim's" jewelry display was able to track the victim's website and suddenly show up. He's still on the bench while he gets away with passing judgement on defendant's that could just as likely be innocent but in this court they are presumed guilty.
You do not have to "hate women" to see this absurdity and ego mania as being counterproductive. I have daughters that I would like to have protected but the abuse of this system tells me that it's a matter of time before this system is going to collapse.
If false arrests are prosecuted with similar penalties that the suspects face, then those making accusations will eventually start to seem more credible and it will cut down on the overcrowded courts.
Right now women who have never experienced real abuse in their entire lives openly brag and even egg their friends on to file false petitions to get the last word as "empowering." Your idea of saying that it sukcs but it has to stay that way is like saying that rape sucks but that's life and we can't seem to get rid of it so we might as well give up.
The hispanic woman that I mention in another post claims that the court recorder checked box for "domestic abuse" only because they had a child in common. The woman later requested that the injunctioned be dismissed and the judge became angry and accused her of being stupid and denied her request.
This judge always gives this long winded speach and gives the defendant two choices to either have a hearing and then he lies about not seeing anything about the case but if he sees anything he doesn't like he makes all kinds of threats. The second choice is you can say "Your honor, I deny all charges and promise to leave her alone" and we can all go home.
Well the defendants do not know that this is a no contest please and that they are admiting guilt and they can give up any hope of having any career teaching or in law enforcement. It sounds more like a warning than a no contest plea and the judge does not warn of the circumstances that such a plea will create. Only the circumstances of the first choice.
Now this judge has a horrible record with appeals courts especially his bias in favor of hispanics but most defendants can't afford to take it that far and they have usually screwed it up for themselves by signing off on the verdict even if it is compleatly contrary to what went on in the courtroom.
Now people who characterize challenges of this system as a symptom of hatred of women are just as much a part of the problem as anyone else. It's a sign of either gender bias or or ego mania that has polluted this branch of the court system.
