I think the writer got some methaphors mixed up -

a. Michael Moore as Lady Justice would be fat, whether dressed in a robe or a t-shirt;

b. Michael Moore is not widely accepted as impartial;

c. it ain't over until the fat lady sings.

Still, you ask a good question. The whole concept of justice in the USA is going to need a recovery period from the Ashcroft/Gonzales days. Mukasey needs work hard to avoid further embarrassment for the Justice department.
