Fair Comment?

Unfortunately, there is no doctrine in copyright law recognizing "fair comment." What there is is fair use, which is a four factor test that is notoriously unpredictable. Being non-commercial, in some cases parodic, and limited in the amount of the episode actually used, the author of the article is correct that these videos would likely fall within the fair use exception to infringement liability, but YouTube isn't under any obligation to stand up to media take down notices on the basis of a tenuous fair use analysis.
