In my opinion, this qualifies as a "hate crime".

But I think that those who wrote and signed the bill believe that the victim must be black or gay and the person committing the crime must be white in order for it to qualify.

murder charge will stick (if he is alive to go to trial) because there were witnesses. Adding the "extra" charge of a hate crime is possible if there is evidence he committed the crime (the way the law is written) out of hate for those persons' race, disability, sexual orientation or sexual identity, or religion (we don't know if any Muslims were killed or wounded either). If the sentence for capital crime is death, I don't see how they'd be able to ask for a worse punishment than that if it is determined to be a hate crime. I doubt it will be, since all those people were part of various groups - not one particular group.

use the term "infidels?" I don't think you know for sure if the victims were all of the same race, religion or sexual orientation. There may have been Muslims in the group that were targeted - not all of them had to be victims.

Killing jews because they are jews would be a hate crime. The victim doesn't have to be black or gay and the perp white. Hey, lacking knowledge is one thing, but acting like a complete dumbass is another.

Lets say someone hated Jews and was out to kill Jews. At the killer's house police find papers were the killer says he hates Jews and his mission is to kill Jews.

The killer goes to a place were Jews are and kills 10 people but 3 of the dead are NOT Jews. This wouldn't be a hate crime then?

If the target is based on hate of a specific group do all the deaths have to be only of that specific group? That isn't logical to me but I admit I don't know the hate crime law well.
