LIE

• Section 7203 – misdemeanor willful failure to pay is punishable by a fine of up to $25,000 and/or imprisonment of up to one year.

• Section 7201 – felony willful evasion is punishable by a fine of up to $250,000 and/or imprisonment of up to five years.” [page 3]

TRUTH:

There is no section 7203 or 7201 in H.R. 3962. It ends at 3205.

Do a word search and you'll find "felony" only once in the bill, and you won't find "evasion" anywhere.

The only reference to "prison" is that prisoners are not eligible under the bill, and government officials who release confidential information can be imprisoned.

THOSE ARE LAWS IN THE IRS TAX CODE FOR FAILURE TO PAY TAXES

So if you fail to comply with the democrat party's compulsory health care scheme, you will be slapped with tax fines.

AND THE PENALITY IN THE IRS TAX CODE FOR FAILURE TO PAY TAXES IS..

The only way you can conflate your contention is by using the Repugnant's talking point of health care as health "tax." Even if the IRS is made responsible for collecting any penalty for failure to purchase insurance doesn't make that penalty a tax. Therefore the failure to pay the penalty isn't subject to the tax code. Just more crap from your "misleading" (i.e. LYING) "Representatives."

If it's not a "tax" as you say, then why is the IRS responsible for collecting it and why does the health bill reference the words "tax penalty"?

Because that's their job....collecting the money. Still doesn't make it a tax subject to tax laws.

Section 59B. TAX ON INDIVIDUALS WITHOUT ACCEPTABLE HEALTH CARE COVERAGE.

‘‘(a) TAX IMPOSED.—In the case of any individual who does not meet the requirements of subsection (d) at any time during the taxable year, there is hereby imposed a tax equal to 2.5 percent of the excess of—
(1) the taxpayer’s modified adjusted gross in come for the taxable year, over
(2) the amount of gross income specified in section 6012(a)(1) with respect to the taxpayer."

‘‘(b) LIMITATIONS.—
‘(1) TAX LIMITED TO AVERAGE PREMIUM.—
‘‘(A) IN GENERAL.—The tax imposed under subsection (a) with respect to any tax payer for any taxable year shall not exceed the applicable national average premium for such taxable year.

I'd say it's pretty obvious that it's a tax, and thus subject to tax evasion law.
But Republicans pay plenty of taxes for health plans they don't like every day (Medicare, Social Security); why is this specific tax worthy of the 5-year imprisonment felony hype?

Lemme ask you a question. Since you don't like Medicare and Social Security will you forgo them? See, I don't like paying for wars but I'm required to pay whether I see the benefit to MYSELF or not. In regard to the 5-year imprisonment, isn't that for fraud? Like if you say you have insurance when you don't, and you provide bogus proof of insurance, or you try to weasel out in some other way? Kinda like you kooks who think you've found manna from heaven in some idiot's book or youtube posting about how taxes are unconstitutional and it's written somewhere in the code that you don't have to pay it? And the "tax" apparently will go toward buying you a policy saving us all from paying for your ER visits. BTW, wade on through. Apparently you're relying on information from July or HR3200 not the current HR3962, neither of which has passed. And, this is only from on body of congress, not both. You people get way too much up in arms over crap that is small. <link>
