Why are the Cops Not Arrested?
by Muddy_Buddy
If the police are making arrests on a law that has been very publically thrown out, is that not a criminal violation by the police? A police officer has a very clear responsibility to know the law, so it seems they are clearly guility of a crime here.

Because that would require a level of rationality and fairness that just doesn't exist in our legal system. They have this idea that it's no big deal (for other people, that is) to be thrown in jail because they do it all day long. It's actually a HUGE deal, extremely traumatic, and very expensive, yet they do it with no regard whatsoever for the person involved. But try holding them accountable for their very real actions and you get a bunch of crybabies.

1) "Ignorance of the law is no excuse" only applies to regular people, not them.

2) Who's going to arrest cops? Other cops? Yeah, that's going to happen. Who's going to prosecute cops? The DA's that work with the cops on a daily basis? Good luck with that.

3) Cops are out there protecting us from them. Of course, when you look closely it starts to look a lot like "us" is cops and "them" is... us.

In addition to all the above posts (with which I do not disagree), also an officer cannot be punished for an action that he/she did while acting in good faith with his/her understanding of the law. Now you have to prove beyond reasonable doubt that this is not what the officer was doing. Combine this with the fact that the law is still on the books, and still in their manuals, and you are going to have a tough time.

The "good faith" ruling was a huge expansion of police powers. All the cop has to do is say "I thought he looked (armed, stoned, evil, like Bin Laden etc) and they are untouchable. Unless they say they stopped them because they looked gay or black or a good victim for a senseless ass-kicking they can make up literally anything and avoid discipline. I have never understood why cops who illegally search a place are "punished" by having the case thrown out. I don't want to make the cops job harder, just send them back through training on the fourth amendment a couple of times before firing them the third time. We should not be compromising our rights to make the cops job easier. Their job is all about following the rules yet they don't want to.
