Willing?

Regardless of the probation officers report, there was nothing willing about the sexual encounter. Read the victim's grand jury testimony at SmokingGun. Polanski convinced a 13 year old girl to pose topless for him by taking photos for a phony photo shoot. He got her drunk by repeatedly asking her to drink champagne as part of that photo shoot, and he also gave her a quaalude. When he began to make sexual advances, the victim repeatedly described herself as being afraid of Polanski and asked him to go home multiple times. When he kissed her and performed specific sex acts on her, she repeatedly told him no. She also said she wanted to cry. That doesn't sound like a willing partner to me – that's rape. The probation officer's report reads to me like a classic apologist and misogynist case of "blame the victim." I thought we had moved past this as a society.

You have to remember that 40 years ago they tried to do everything to blame the victim. If you ever sat in on a rape trial (which at that time you had to be involved in some asset of the trial or in law enforcement at least in my area) you would have seen what they did to the victim to make them out to be sluts and whores. I just happened to be getting into law enforcement and got an opportunity to sit in on a rape trial and I was appalled at how they made it like the victim instigated the whole thing.
