To withhold that you have herpes that is? That would surely qualify as some type of physical abuse.

Perhaps the concerned friend should point out that she could get sued or charged in some way.

To make it a criminal offense there would probably have to be an intent to injure. If I were defending her in a criminal case, I'd certainly hope to be able to argue that she never had sex during an outbreak, was medicating, and always used a condom.

For a civil case, there would have to be at least a failure to use reasonable care. Again, the same arguments in defense might carry the day.

There have been such civil suits and criminal charges, but I seem to think most of them have been tossed.

..."knowingly spreading an infectious disease". I'm sure some of the states do, too. I seem to recall a guy being charged with assault for not treating his special form of clap while his wife DID. He told her to get tested, she started treatment, but he never treated his own case. ______________________________­______________________________­______________________________­______________________________­_________________________inser­t paragraph break here__________________________­______________________________­______________________________ Something stupid like that. I think he had to pay a fine in the end.

Guy in Dallas recently got 45 years for knowlingly spreading HIV. "Aggravated assault with a deadly weapon".

I would think you would be guilty of reckless endangerment or the equivalent in most states. I'd imagine it would be considered tortuous conduct too. I don't plan to research case law on either question.

Someone at Slate decided that I'm not allowed to have paragraph breaks any more, so that's the only way I can post. I think they'd love to ban me, but they don't have grounds so this is their solution. Nice, eh? Send me an e-mail at messy-one@hotmail.com. Trust me.

They don't need grounds to ban you MessyOne, they would just do it if they wanted to. Have you tried a different web browser?

The problem isn't the browser or my computer (hard to mess with Apple), it's Slate. Believe me, I've been over everything.

I've only ever heard of cases involving the knowing spread of HIV, and even those were sort of out-there cases, but I don't know if that's because of a legal deficiency in the claim or because nobody wants to go file a police report when they find out their girlfriend gave them herpes. Kind of interesting to imagine how that would go, though...

I would think a civil claim would be easier but again, probably not worth it to most people unless Herpes Mary is loaded.

Weird. Spinning a Yarn seems to be having the same problem. Though it seems to me that if they think eliminating your paragraph breaks would get rid of you, they haven't really been paying enough attention...

The Model Penal Code defines reckless endangerment as "conduct which places or may place another person in danger of death or serious bodily injury". I think giving someone herpes would count, but I doubt the matter has ever been adjudicated.

Just tossing in my $0.02 here.

As you can see, when I post from a Windows-based computer, I get the old automatic double line feed between paragraphs just by hitting "Enter" once.

Last night, I posted a brief reply from my iPhone. While I was writing it, I noticed that I was only getting single line feeds from hitting "Enter" once, so I tried to force a little white space by hitting it twice.

The result was this: <link> No line feeds at all. The entire thing mushed together in one paragraph.

I don't know if that's because it was an Apple product, or because of the mobile interface, or because of the double "Enter." Anyway, maybe these are some clues.
