Done feeling guilty about smokers' "rights"

Having lived next door to a very heavy smoker, subject to her smoke any place our condominiums shared a wall space, electrical outlet or venting piping, I am completely through worrying about someone else's "right" to invade any part of my life with cigarette smoke for even one more day. While I never ran to the management to fix my problems, I did attempt to work with the neighbor on solutions. Her solution to many things in her life, including her daily regularity, was a cigarette in the bathroom while running the fan. Her solution to too much smoke in her apartment was to smoke on the balcony with her friends - just upwind from my open glass doors. Living in California, particularly where it is possible (and desireable) to have doors and windows ajar for most months of the year, the "let's smoke outdoors" solution just means that your guests may decide to lounge outdoors in front of MY place and exercise their "rights" . Sorry folks, but your rights end exactly where my airspace begins - 24/7. I no longer live in that condominium, in no small part because of my smoky neighbor. To make it plain, in my world, smoker's don't have rights - they've got a problem.

Your nickname is freedom lady and I guess that is a good nickname since it appears you only believe in freedom for yourself. This is no 'in my world' since there is only ONE world that everyone must learn to share.

I believe it should be up to the apartment owner to decide the rules around smoking and if tenants should be evicted or not because they impringe on the rights of other tenants. Thus in an apartment complex it is the apartment owners 'world'.

For Condo there is at Condo association. Now there are a lot of legal mumbo jumbo associated with Condo owner rights but either way the associaton controls the 'world'. Renters of Condo are just tenants and must follow the rules to protect the actual owner.

Home owners of course have their own 'world' and thus have more rights. This is one of the main reasons I own a home. I couldn't play live music in my Apartment and then condo so I got a home.

I have been reading the posts here, and until Freedom Lady posted, elected to stay away. Jazz, I agree that your position on private property has merit but all along I waited for the person to post about outdoor smokers infringing upon their "rights". Let's face it, most new homes today are built within developments lacking any "sight lines" separating each parcel of "private property". Thus, what the anti smoking zealots really desire is governmental intrusion/regulation - private property be damned!

Yes, I'm sure there are anti smoking zealots that wish to ban smoking even outline in ones own yard. These people clearly don't respect private property rights.

Now I can see where outdoor smoking would be restricted; For example, say at a bus stop where many people might be gathered in a small outdoor area, but the topic of outdoor smoking came up related to public parks and to me that was going too far.

People should just be carefull what they wish for. Some behavior they don't like or do may be banned today, but then something they do like or do may be banned in the future!

what a crock you smokers spew out on this forum. You don't care about freedoms except your freedom to get that next drag.

you don't care about property rights except your right to that next drag.

you don't care about big government taking away rights except your right to piss in my air.

in short, you don't care about anything or anybody except that next drag. It is not possible to have a proper conversation with a smoker about their noxious, dirty, disgusting habit. They just don't care.

Well, Bigfeet, I think maybe you have a problem also! I don't smoke, never have smoked, but have no particular problem with other people smoking. I agree that in a confined area, second hand smoke annoys my lungs, but in a park or other open air venue, I have the option of simply moving over a few feet to escape.

While you may find smoking to be a noxious, dirty, disgusting habit, I find self-righteous, hypocrites to be much the same. For example, I loathe and abhor television, don't own one, won't have one. It deadens the mind even more than smoking deadens the lungs, and ultimately is much more dangerous to the future of our world. That doesn't mean I'm going to tell you not to watch, even though when I visit someone and they spend the entire time glued to the tube instead of actually conversing, I'd really like to reach over and jerk a few plugs out. I simply choose not to visit such people very often.

Listen bigfeet I do NOT smoke and I do NOT enjoy being around people that do smoke, but being a liberal I do care about too much government control and I do respect property rights.

So why not just be mature and make a good case on why the private property owner (the apartment owner) shouldn't have the right to determine if THEIR complex allows smoking or NOT. If I didn't own a home I would only rent in a non smoking complex and if I owned an apartment complex it would be non smoking.

how right you are....they don't care, they are obnoxious and totally idiotic, and they will spew anything.....thank goodness there are so few left. Unfortunately even 20% of them are still working on killing our 80%

they are fighting so hard because they know they have lost and are losers. Their day will come

Ok, I see that you hate them. Are you sure you don't belong to a group the majority will also call loser and wish to stamp out? The apartment owner should have the right to determine is smoking is allowed on his property as long as smoking is still legal. You sound a little too much like the Taliban.
