Supreme Court pick Sotomayor under fire for comments

WASHINGTON — Sen. Jeff Sessions — the top Republican on the Senate committee that will grill Supreme Court nominee Sonia Sotomayor— knows what it is like to be on the other side of the witness table.

Two decades ago, he was a judicial nominee fielding questions from senators about allegations of racial insensitivity and, ultimately, failing to win confirmation. Sessions said his experience means he will give Sotomayor plenty of time to defend herself and explain her judicial philosophy.

"I don't approve of springing charges against a nominee in a way that gives them little opportunity to respond and that are actually distortions of their record," the Alabama senator said in an interview Thursday.

Still, Sessions indicated he will not shy away from controversy. He said Sotomayor needs to explain what she meant in 2001, when she said: "I would hope that a wise Latina woman with the richness of her experiences would more often than not reach a better conclusion than a white male who hasn't lived that life."

Sessions called the statement "troubling."

One of the things I hate about partisan politics is how the opposition will take a single statement to prove their point.

Sotomayors record in her rulings is important. One statement made years ago is not and makes the republicans look stupid when they attack her with it.

Yes, her record is what is relevant, not one statement made in a speech.

Based on what I know, I do not think she will be a good Justice.

SCOTUS is no place for a racist. She is obviously one,...so am I but I'm not lobbying to sit on the bench. She should just come clean and admit it. Stop the liberal "end around" balony. She "misspoke". She was taken "out of context". Bullshit. She said what she said and she can't take it back. Imagine Justice Roberts saying a white male would make a better judge than a latino woman. As an appellate judge she’s participated in over 300 opinions, of which 3 (Entergy v. Riverkeeper, Correctional Services Corporation v. Malesko, and Merrill Lynch, Pierce, Fenner & Smith, Inc. v. Dabit) have been overturned by the Supreme Court.

Of her 300+ decisions, only five reviewed by the Supreme Court, the rest stood. Of the five the three above were reversed. That comes to 60%. The Court reverses around 70% of the cases it actually hears.

If Judge Sotomayor’s 60% reversal rate is a disqualifier, should Justice Alito be removed from the Court? As an appellate judge, every, all, 100%, of his rulings that were reviewed by the Supreme Court were overturned.

When you hear something on talk radio, don’t you ever have the intellectual curiosity to verify the claim?
