republicans livid?

You would think they would be pleased that, in a dramatic about face, the new Justice Dept is capable of showing mercy, a trait long missing save towards polluters, security contractors and no bid cost plus looters. There is no doubt that Bush Justice Dept prosecutors deliberately botched this trail to provide an appeal escape hatch for Stevens. If petty little republicans want to get livid, they should direct it at themselves for supporting a totally corrupt and inept Bush Justice Dept.

It's not as if there wasn't enough evidence to convict Stevens ten times over.

Throughout the trial, Stevens had accused federal prosecutors of blatant misconduct, and shortly after losing the election it became clear that his were not your typical “I wuz framed” allegations.
To the contrary, the foulplay of both the DOJ and the FBI has been so stark that Judge Sullivan has continually postponed sentencing. In fact, in February, Sullivan held four senior DOJ prosecutors in contempt of court for failing to comply with his order to turn over 33 documents to Stevens' defense team. All four were immediately replaced by the DOJ.

Special Agent Chad Joy, an FBI whistleblower, confirmed that prosecutors had routinely concealed evidence that would have helped Stevens' defense team. Joy also submitted a complaint containing allegations of misconduct regarding his co-case agent and federal prosecutors, listing twenty-three categories of “intentional specific law enforcement and/or prosecutorial misconduct.”

And that appears to be but the tip of the corrupt iceberg. Allegations also include witness relocation, failure to forward evidence to the FBI, improper investigation revelations and much more.

And get this -- in addition to a new trial, Sullivan is said to be considering defense attorneys’ requests to begin questioning FBI agents and DOJ officials involved in the case.
So am I the only one wondering what really motivated Holder’s decision to withdraw DOJ’s opposition to the defense motion for a new trial and to dismiss the indictment?
Or, if his prosecution is proven to have been purely politically motivated, whether it’s too late for Ted Stevens to challenge last November’s election result?

the trial judge was going to hold a hearing in 2 weeks to gather evidence on the improper relationship between the prosecutors, who indicted to coincide with stevens reelection, and the primary witness against stevens, who lied on the stand. All reports are that the judge did not believe anything that the old prosecutors OR holder were saying and was going to slam them. Holder did what he did to prevent further digging into the politically motivated misconduct

Trig, glad to see their will be an investigation on this one...heads should role...reminds me of the Duke case a few years ago. Over zealous people....ruined a man's reputation. Sad case!

Hmm. When it comes to politically motivated cases, when can the case of Susan McDougal, who Ken Starr put in jail for years for refusing to LIE about the Clintons, be reviewed?

Or what about that guy in Alabama that the Cons massacred?

From personal knowledge there are plenty of democrats among the staff prosecutors [AUSA's] in DOJ, particularly among the lifers sucking on the government tit, and they were hostile to the GOP. They are not political appointees and cannot be replaced in a GOP administration. Just like that government-tit-sucking perjurer Valerie Plame at CIA, they work to undermine a GOP administration. Shit, You libs got your panties in a twist when bushie wanted to replace a few of the incompetent or left leaning US Attorneys, who are political appointees.

If there was prosecutorial misconduct, it was the responsibility of the judge to declare a mistrail.

Stevens is on tape discussing ways to hide the fucking bribe you fucking retard.
