If you read your post you will see that it references, repeatedly, the fact that warrantless wiretaps are allowed on international calls. That is nothing new. The original FISA bill did much the same. What the Bush folks had been doing was following the calls to include domestic calls. If my friend in Israel calls me, then the NSA would consider that as justification to tap my phone and would include domestic calls.
The ACLU did not seem to draw a distinction between civil and criminal actions against the Telcos. The FISA bill does not prevent criminal actions against the telcos. It also does not prevent criminal action against the government officials who ordered the wiretaps.
It makes no sense to me that people would sue the telco and therefore punish the stockholders for what they were instructed to do by government officials.....It does make sense that the government official who ordered it would go to jail.
