The reason that you hear all that dreadful blather at the end of those drug commercials about what this drug or that drug will do to you if you have liver conditions or - my favorite - an erection that lasts for more than four hours is that the Pharmas are trying to protect themselves from liability should something go wrong while their medicine is being administered to you.

If South Dakota is mandating a warning that may or may not be correct concerning the consequences of an abortion instead of letting the doctor give a realistic analysis of the operation, isn't the state holding themselves liable for the consequences?

Somewhere in South Dakota, a law firm is sharpening it's knives and waiting.....

I wish. The prospect of the state getting caught in the web of its own idiotic law would be a nice silver lining.

However, if they can get away with essentially writing the definition of "human being" for purposes of this law, they could probably get around the liability issue too.

I can envision a lawyer staging a scenario where the state's advice is taken to the detriment of their client.

Calling all ambulance chasers. I fully expect to see one of those late nite lawyer ads: "If you are a loved one has taken the advice of the state of South Dakota on any abortion procedure....."
