While I AGREE with the U. S. Supreme Court's "GITMO" majority opinion that "all enemy combatants detained during a war, at least insofar as they are confined in an area away from the battlefield, [but] over which the United States exercises 'absolute and indefinite' control, may seek a writ of habeas corpus in federal court," I also AGREE with Chief Justice Roberts (and his fellow dissenters) that the Writ can be suspended in time of war, such as the war on terror that we find ourselves involved in right now, and that suspension power belongs to Congress, such as Congress has exercised in this case, "as the Constitution surely allows Congress to [wield]."

Does Chief Justice Roberts mean when Congress has actually declared war (as it is given that sole responsibility in the Constitution which Roberts has sworn to uphold)?

Since there has not been an actual declaration of war by the US Congress since December 8, 1941, the neo-tards may want to be careful in their interpretations here. Don't you think?

Um teigan, thought you believed in the Constitution.

Go to court, show your evidence and prove they're guilty as charged (when you actually get around to charging them with anything). Otherwise, what you've created is a bunch of pissed off guys, the majority of whom were no threat in the first place, who will go back home intending to do harm NOW to get their revenge.
