Landsburg fails to mention that the formation of a contract requires a "meeting of the minds," in order to be legally enforceable. A very strong argument could be made that there was no meeting of the minds for most of the "contracts" that have resulted in foreclosure.

These are the types of contracts that society does not want enforced. These are the types of contracts that society wants banks to be reluctant to create.
