Let's get it clear on Iraq

The war itself is illegal, since it's a war of aggression launched against a state which in no way threatened or had attacked the United States of America. The invasion and occupation were based on false claims that Saddam Hussein's government had WMD, and that he was a threat to his neighbors and the U.S., both patently false. And the war and occupation were NOT sanctioned by the U.N., they were entirely unilateral...and like all aggression (including Saddam's own attack on Iran and occupation of Kuwait), patently illegal, a violation of international law and behavior.

So, ANY order requiring American servicemen to invade, attack, or occupy Iraq was therefore an illegal order, a violation of international law as well. Therefore, according to the Uniform Code of Military Justice, no American soldier should be required to obey such orders or serve in Iraq. Indeed, he would have a duty NOT to obey such orders.

I salute any soldier who choooses not to obey orders to deploy to Iraq....they clearly not only put country and morality ahead of criminal orders, but put their own Military Code ahead of such orders. As they are required to do.

Easy solution, of course, would simply be to END the war and prosecute those who began it, starting with Bush and Cheney. As a patriotic American, I look forward to that day..

yep, and as far as I know and recall, the Lt. that contested his orders to deploy is still a free man, because the court didn't want that "legality" issue and all others tied to it addressed.

I'm not sure where that case is presently

Yes soldiers...ignore your commander and chief under authorization from the US Congress...the UN hasn't approved this mission.

The legal status of the war is not entirely relevant. I don't want soldiers making these decisions. If the Democrats had balls, they'd start the impeachment process, dry up funding for the war, and put pressure on Bush to wind it up over there. They haven't done that.

You don't want soldiers making these kinds of decisions. You surrender some of your rights when you join the military.

And don't forget antiamerican.

You miss the greater point, and while you may disagree wholeheartedly regarding the legality of the "war", the fact is, no soldier is required to follow an illegal order, no matter who presents it, even the CIC.

"Illegal orders," as I understand them, apply in the combat zone. The decision to go to war is a political one. I don't think it's the same thing.

One of my best buds is a Marine. He's very very very smart and very very very demanding. He knew every bit of the Military Code...and would refuse illegal or even poorly constructed orders. That was at Parris...

He jumped up and down the enlisted ranks like a pogo stick...
