In the grander scheme, The Church is about reconciliation and forgiveness. So..for the Pope to start throwing people under civil and legal buses, would be contrary to his"mission".
More to the specific legal point though, these men of the cloth have been accused of very serious felony charges. There's little doubt that there's a mountain of "guilt" going on there. But...given The Church's tepid legal defense of its people, in terms of specific charges, AND their deep pockets, it's also reasonable to assume that a siginifcant number of these charges are bogus. For many reasons in keeping with its "mission", The Church has decided to accept for itself, a sort of "universal guilt" - sparing the individual victims and non-victims, from having to make their cases in courts of law.
But...having chosen to do that, they've precluded themselves from subjecting their own, to specific legal charges. As a matter of our legal system, if not fundamental ethics and morality, an individual charged with a serious felony and facing criminal sanctions, MUST be allowed to defend himself to the fullest extent of the law. And again....the Church has decided (correctly in my opinion), not to subject the victims and non-victims to this process.
