You seem to be asserting that one instance of an "unfair" finding (when deferring to the legislature) means that the court is completely unconcerned with fairness.

Think about that the simple syllogistic fallacy of that reasoning.

And, once again, consider O'Connor's observation that it's a common law court. (And thus not solely about constitutional interpretation.)
