‘‘(C) DESCRIPTION OF CHILDREN NOT
20 SUBJECT TO WAITING PERIOD.—For purposes
21 of this paragraph, a child described in this sub22
paragraph is a child who, on the date an appli23
cation is submitted for such child for child
24 health assistance under this title, meets any of
25 the following requirements:

1 ‘‘(i) INFANTS AND TODDLERS.—The
2 child is under two years of age.
3 ‘‘(ii) LOSS OF GROUP HEALTH PLAN
4 COVERAGE.—The child previously had pri5
vate health insurance coverage through a
6 group health plan or health insurance cov7
erage offered through an employer and lost
8 such coverage due to—
9 ‘‘(I) termination of an individ10
ual’s employment;
11 ‘‘(II) a reduction in hours that
12 an individual works for an employer;
13 ‘‘(III) elimination of an individ14
ual’s retiree health benefits; or
15 ‘‘(IV) termination of an individ16
ual’s group health plan or health in17
surance coverage offered through an
18 employer.
19 ‘‘(iii) UNAFFORDABLE PRIVATE COV20
ERAGE.—
21 ‘‘(I) IN GENERAL.—The family of
22 the child demonstrates that the cost
23 of health insurance coverage (includ24
ing the cost of premiums, co-pay25
ments, deductibles, and other cost

ILY INCOME.—For purposes of sub5
clause (I), family income shall be de6
termined in the same manner speci7
fied by the State for purposes of de8
termining a child’s eligibility for child
9 health assistance under this title.’’.
