No you are not. You are forced to pay your taxes. And you CHOOSE not to take the deduction offered you if you do not carry 3rd party insurance.

Revenue collection and opting into medical reimbursement program are two different things. Constitutionally they are not linked. They might be in public rhetoric, but not legally nor Constitutionally.

You are just paying your taxes and CHOOSING not to act in a way that gives you one type of deduction. No different than choosing not to invest in a gas well head and thereby foregoing the annual depreciation allowance
