First off, Am 16 allows The Feds to tax as much as they want. So on the legality of taxation you don't have much of a leg to stand on.

It seems you have this hang-up where every time you hear someone say that something is a bad policy you for some reason start arguing that the congress has the constitutional authority to enact that legislation and you seem to think that somehow disproves the point.

Nobody is arguing (at least not here) that the progressive income tax is unconstitutional. The point being argued is that it is bad policy. Try to keep that idea in front of your mind for a bit.
