It's the "gray area" decision making as it pertains to sex that bothers me. Change the scenario to a women handing her wallet to a man, and she would probably have just as weak of a case as I would have. But, when things turn to sex, there's a gray area. Specifically, if it's a case in which it's far from her first time and a condom was used--essentially, that it was safe, consensual sex. How exactly has she been harmed? The person who lost their wallet would seem to suffer more, no?
