You're missing the point. It is illegal to drink and drive and shoot random people. Its not legal to abuse alcohol in that way or to abuse guns in that way.

Killing/injuring people with guns/alcohol comes from abuse of those things (which is illegal). Killing/injuring people with smoking just constitutes plain old use, not abuse. Thats just what it does.
