Wow.

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press, or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

Seems like a rather broad prohibition, with no carve out to allow Congress to abridge the free speech of individuals who associate themselves into a for-profit corporation.

This is a less-discussed danger of the "living constitution" approach. By making our rights subject to the latest whims and fancies of the legal intelligensia, we not only loose our ability to govern ourselves, but the rights that actually are enshrined and enumerated become watered-down.
