You wouldn’t happen to have a link for that, would you? (Other than the fact that Rush said it.)

As an appellate judge she’s participated in over 300 opinions, of which 3 (Entergy v. Riverkeeper, Correctional Services Corporation v. Malesko, and Merrill Lynch, Pierce, Fenner & Smith, Inc. v. Dabit) have been overturned by the Supreme Court.

Of her 300+ decisions, only five reviewed by the Supreme Court, the rest stood. Of the five the three above were reversed. That comes to 60%. The Court reverses around 70% of the cases it actually hears.

If Judge Sotomayor’s 60% reversal rate is a disqualifier, should Justice Alito be removed from the Court? As an appellate judge, every, all, 100%, of his rulings that were reviewed by the Supreme Court were overturned.

When you hear something on talk radio, don’t you ever have the intellectual curiosity to verify the claim?
