Sotomayor’s “Flagrant bench racism against white firefighter”?

In June of 2004, 21 white firefighters filed a complaint with Connecticut’s Commission on Human Rights and Opportunities. In November of that year the complaint was thrown out. Judge Sotomayor was not on the commission. The firefighters then filed with the Federal District Court.

In the autumn of 2006 the United States District Court found in favor of the City of New Haven. Judge Sotomayor was not on that court, either.

In 2007 the firefighters filed with the 2nd U.S. Circuit Court of Appeals. A three-judge panel refused to hear the case, allowing the lower court’s ruling to stand. Judge Sotomayor was one of the three. The firefighters then asked the 2nd U.S. Circuit Court of Appeals for an en banc hearing, the request was denied. Judge Sotomayor is one of 12 judges deciding to allow the lower court ruling to stand..
