Exactly--no one is going to pass a law to change a constitutional right. The point is what justices the president will nominate. Bush already nominated two conservative justices. At least one more is likely to retire during the next term, and maybe more. Who replaces them is important. The political parties might not want the issue settled, since it's such a great fundraiser for them, but someone is going to bring another abortion rights case, or several, and even if Roe isn't overturned, it could be eroded pretty far. It does, in fact, matter who is on the Court and where they stand on Roe and their willingness to either overturn it outright or gut it completely and leave it standing in name only.
