Did they or did they not violate the conditions of the Cease Fire agreed to in Desert Storm? Did they or did thy not fire missiles at American aircraft? Did they or did they not retaliate against their political enemies? An act of war is as good as a declaration of war.

That would have been a better case, but I doubt Congress would have approved a never ending war for something that could be handled with a couple of quick bombing runs and a few cruise missiles.
