Degs, this is why it is important to controll access, insofar as is practicable. No border can be sealed perfectly, but we can at least make an honest attempt to try -- at the point, employers wouldn't have to worry much about legal or illegal -- most people they hired would be legal.
But really you are using a piece of legal trickery to invalidate the immigration control authority that is granted to the federal government via the Constitution, and that power has been there since day one. If the two pieces of the Constitution clash, then that is a matter for the courts. I can't believe any rational courts would decide that there is no basis for immigration law.
