As usual, Dahlia Lithwick is right on point: The Supreme Court, and the judicial system it supports and sustains, is coequal with the President’s administration and members of Congress. The justices must actively engage in protecting each individual’s rights as a human and as an American, otherwise there would be no check or balance.
The right to habeas corpus is a perfect example of the tired phrase “judicial activism.” The dissenters chose politics and inaction over principal and the law. The majority tried to educate us to something we should hold dear; and they acted on that philosophy. It is quite refreshing to see at least one of the branches bring thought, logic, and tradition to the forefront of a discussion.
I grew up in an Ohio town whose most prominent billboard read “Impeach Earl Warren!” I would just wait: Roberts, Thomas, Alito, and Scalia will pass and be forgotten.
