Kill all the lawyers was an idea invoked to make it easier to establish tyranny. The problem with detainees is that they are accused of a crime, not found guilty of one. Punishing someone for being accused of a crime is the most difficult part of any civilization. Even the ancient Romans realized that and guaranteed that a Roman citizen could confront his accuser. If our way of life is worth fighting and dying for, it is worth living by. And if that requires an extra measure of courage from the average citizen, I am willing to try to do my share. And that's no bull.
