Sometimes the majority is wrong. Being correct is more important than simply being the will of the majority.

This is true. But being wrong is not always the same thing as being unconstitutional.

For instance, I believe that progressive taxation is unjust. I think that it is wrong and should be abolished. But I cannot claim that it is unconstitutional just because I could make some weaselly argument about "equality under the law."

The fact is that a free, self-governing society is sometimes going to make mistakes, and we are probably going to often disagree about what is and it not best. That does not mean we should cede the power to make those decisions to unelected judges instead of our elected representatives.
