The actions described in this story do not surprise me. Recently, the Massachusetts Board of Bar Overseers moved to disbar a criminal defense attorney named Wayne Murphy for literally stealing a client’s settlement in a civil case while he represented the man in his criminal action. After allowing his client to be incarcerated, he simply stole a settlement in an accident case while the man was in jail and his girlfriend the other victim lived in a halfway house. The system allows an attorney with a pending BBO complaint to at the same time be representing another individual, Michael McGunigle, in a notorious manslaughter case that is all over the news. This man does not know about the actions of his criminal defense attorney and believes he will receive competent defense. This attorney has previously been suspended by the BBO and this new complaint includes his continuing to practice law while suspended. What protects a client from their own lawyers? The answer is obvious, not much. This man is the subject of numerous complaints and malpractice lawsuits but continues to find new victims, I mean clients. Why are attorneys allowed to have the power to ruin people’s lives? What a joke!
